Shaw Communications Inc. has applied to eliminate the conditions of licence pertaining to structural separation for its Star Choice Television Network Inc. In its application, which the CRTC published Tuesday, Shaw said the rules were imposed 14 years ago and that the context has changed. The company said Canada’s broadcasting distribution market is now more competitive and that section nine of the CRTC’s Broadcasting Distribution Regulations addresses alleged preferences or disadvantages. Shaw also argued that no structural separation conditions have been imposed on its competitors and that the condition affects its ability to respond to competition from over-the-top services like Netflix Inc. as well that from traditional broadcasters. Comments on the application must be submitted by the deadline of May 13, 2011.
