The Federal Court of Appeal has dismissed an appeal request by MediaTube Corp. to present new evidence in a six-year-old patent infringement case brought against BCE Inc. Judge David Stratus agreed with Bell’s argument that the fresh new evidence MediaTube was hoping to present was “already apparent” in the record before the court and MediaTube could’ve investigated the issue during the previous proceedings.
